“Prior art” includes anything found by the patent search: issued patents, published patent applications, and non-patent literature. For each piece of material prior art, you should write down what each does, and what each does not do – without mentioning your own product. For patent documents, ignore the claims and focus on the summary of the invention. Don’t include opinions, only include facts. Write one paragraph per prior art reference, carefully listing the features of each reference and pointing out why each reference doesn’t solve the problem that your invention solves. The technical input from patent applicants helps patent lawyers make the best legal case for your patent.
